No rate classification rule rating plan or modification for an exempt commercial line is required to be filed before use. Loss-cost filings by an advisory or rating organization remain prior approval and workers compensation retains uniform classification and experience-rating requirements.

Method

A commercial form may be used without pre-use approval. If it was not already filed by an advisory organization or the insurer a copy is sent to the Department as soon as practicable after use and retained in a desk file.

A covered personal P&C form must be filed and approved before issue or use. The director acts within 30 days and may extend review; silence deems approval, but the insurer must file written intent at least 10 days before relying on deemed approval.

Method

An eligible overall average rate-level change within plus or minus 7 percent may use a 30-day file-and-use path subject to line-specific frequency and other conditions. A filing outside the band or otherwise ineligible is prior approval.

Combined Form/Rule Form/Rate and Form/Rate/Rule submissions are operationally used. However a personal rate filing relying on the statutory file-and-use path must be filed as Rate or Rate/Rule; a filing containing forms does not qualify for that path.
