Exemption

Rates and policy forms for enumerated commercial special risks are exempt from filing. Covered classes include specified large or sophisticated risks and named coverages such as excess and umbrella D&O EPL aviation credit property boiler and machinery commercial inland marine fidelity surety crime and other listed risks.

Method

Current Department guidance describes an aggregate plus or minus 5 percent flex range for eligible nonbusiness casualty fire and marine rate changes. Rating-plan changes generally do not qualify merely because their indicated impact is within the band.

Conditions and exceptions: Residential property is excluded from flex treatment; use the current governing statute and product instructions before relying on the band.
