Rate · Rule

Method

The Rate Bureau files rates loss costs classification plans rating plans and rating systems. A filing generally may not become effective earlier than 210 days after receipt unless the Commissioner and Bureau agree to an earlier date; hearing and deemer periods are product-specific.

Applies to: Residential property and workers compensation rate loss-cost classification and rating-plan filings

Conditions and exceptions: Property has a 50-day notice-of-hearing/deemer branch; workers compensation uses 60 days for that notice period and has additional effective-date provisions.

Note: Do not collapse the 210-day earliest-effective rule and the shorter hearing/deemer clocks into one approval clock.

Rate · Rule

Method

A proper private-passenger-auto Rate Bureau filing is not effective until approved or until 60 days elapse without the Commissioner calling a hearing.

Applies to: Nonfleet private passenger motor vehicle rate filing

Conditions and exceptions: If a hearing is called the statute supplies separate notice hearing and order deadlines.

Packaging

A filing containing forms and rates is prohibited and is returned for separate submissions. Current approvals show Form/Rule is accepted when the rule material contains no rate data; rate or rating-manual material still belongs in a separate companion Rate/Rule filing.

Conditions and exceptions: Reciprocally identify companion filings. Do not infer that every item labeled rule can accompany a form when it affects premium.

Note: LFST-134933743 enforced separation; MDCC-134902026 approved Form/Rule and stated that rate data did not apply.
