The §44-7513 policy-form approval requirements do not apply to an individual commercial risk of a qualifying multistate commercial policyholder.

Applies to: Individual commercial risk otherwise subject to §44-7513

Conditions and exceptions: The policyholder must be commercial with qualifying common ownership and its senior-management center or predominant covered premium outside Nebraska; other Nebraska law remains applicable subject to listed statutory conflicts.

Note: This is relief from the prior-approval path rather than a blanket exemption from all possible filing duties.

Exemption

A qualifying unique individual-risk form is exempt from ordinary filing subject to notice record and reuse restrictions; second use triggers filing within 60 days.

Applies to: Unique form for an individual risk under common ownership

Conditions and exceptions: The form cannot already have been filed by the insurer or an advisory organization; notice of unfiled provisions is due no later than 30 days after policy effectiveness and the director may impose restrictions or informational filing.

Method

Ordinary forms are file-and-use and may take effect no earlier than the date received. Personal forms must be reviewed within 30 days and may be disapproved prospectively; acknowledgment of receipt is not approval.
