Regulation 72 exempts eligible commercial entities from form filing and approval when the premium size organizational and signed-certification conditions are met; rates and rules remain subject to filing.

Applies to: Commercial property casualty forms other than workers compensation employers liability and professional liability

Conditions and exceptions: Prior-year aggregate commercial premium must exceed $200000 excluding workers compensation employers liability and professional liability and the entity must satisfy the applicable employee population or budget threshold plus certification and disclosure rules.

Note: Do not apply to workers compensation employers liability or professional liability and do not extend the form exemption to rates or rules.

Forms must be filed and approved before issue or use. They are deemed approved after 45 days without action; timely written notice can extend review 15 days and affirmative earlier approval waives the wait.

Applies to: Ordinary policy forms and basic contracts

Conditions and exceptions: The commissioner may exempt categories by order; separately listed individualized forms and qualifying commercial risks have specific treatment.

Method

Current law permits use when filed. The commissioner has 30 days after receipt to reject the filing; the current department handbook calls Louisiana a file-and-use state.
