Exemption

Section 143 does not apply to the listed categories.

Applies to: Surety contracts or fidelity bonds; industrial insured policies except workers' compensation; individual-risk riders or endorsements for special unusual peculiar or extraordinary conditions

Conditions and exceptions: The individual-risk exception is limited to riders/endorsements; Illinois guidance says the underlying individual-risk policy form must still be filed, and repeated use of an endorsement defeats the exemption.

Exemption

The company need not file the individual-risk rate but must maintain documentary support available for Department review.

Applies to: Individual risks not rateable in the normal course because of special or unusual characteristics

Conditions and exceptions: The exception does not apply to workers compensation; Part 754 also addresses property-inspection schedule rates and authorization letters.

Form

Method

Forms must be filed through SERFF, and Part 753 requires receipt no later than the effective date of use, but approval before issue is expressly not required. The Department may later order discontinuance for statutory defects.

Applies to: Ordinary insurer-filed Class 2 P&C other than accident/health workers' compensation fidelity/surety; Class 3 other than group inland marine under Part 2302

Filer type: insurer

Conditions and exceptions: Subsection (2) governs P&C; subsection (1)'s 60-day prior-approval rule governs life and accident/health. Workers' compensation, fidelity/surety, and group inland marine require separate scope analysis.

Form

Method

Licensed rating organizations must file required policy forms and modifications no later than 30 days before effectiveness. A filing may not be effective or used until approved, but is deemed approved if not disapproved within 30 days.

Applies to: Licensed rating organization policy forms and modifications that members or subscribers must follow

Filer type: Rating Organization

Conditions and exceptions: This is a workers' compensation rating-organization rule, distinct from insurer-filed forms under §143(2).

Note: Corrected from an overbroad all-P&C/file-and-use characterization after reading §457 in full.

Form

Method

No policy, certificate, memorandum, application, endorsement, or rider may be issued until the form is filed and approved. The Director has 90 days to disapprove, may extend 30 days by written notice, and the filing is deemed compliant if not disapproved within the period.

Applies to: Group or master policy-certificate inland marine involving individuals' personal property that is owned purchased or pledged as collateral and is not used in a business trade or profession

Conditions and exceptions: Part 2302 exempts other group/master inland marine from filing under that Part; other law may still apply.

Note: This is a genuine P&C prior-approval exception. A 2022 commercial inland marine objection cited §400.1 and computed the exact 90/30-day dates; a 2021 employer-group pet filing received the same treatment.

Form

Method

Section 143(2) requires electronic filing of Class 2(d) workers' compensation forms and expressly does not require approval before issue. Part 753 excludes workers' compensation, so its no-later-than-effective-date rule is not being applied to this row without a separate source.

Applies to: Insurer-filed policy forms not governed by the licensed-rating-organization requirement in §457(2)

Filer type: insurer

Conditions and exceptions: A rating-organization form that members or subscribers must follow is governed separately by §457.

Note: The controlling statute resolves the method: electronic filing is required and prior approval is not. Neither §143(2) nor the current WC checklist supplies a universal pre-use lead time, so no day count is invented.

Part 754 lists medical malpractice as filing-required and requires covered rate/rule filings through SERFF no later than 10 days after their stated effective date.

Applies to: Medical-malpractice rate and rule filings

Conditions and exceptions: Do not rely on 215 ILCS 5/155.18 as operative authority; the Illinois Supreme Court held that provision unconstitutional in 2010.

The recent Illinois SERFF taxonomy contains Form, Rate, Rule, Rate/Rule, rating-organization adoption, and Report filing types but no Form/Rate/Rule type.

Applies to: Combined form and rate/rule filing type

Conditions and exceptions: This establishes current operational configuration, not by itself a legal prohibition.

Note: Resolved as current SERFF configuration: no combined form/rate filing type is available. This does not turn the platform taxonomy into a separate statutory prohibition. Operational configuration verified from current public filing metadata; the authority URL opens the jurisdiction public filing search.

Current Illinois aircraft checklist states that companies under the same ownership or general management must make separate individual company filings and group 'me too' filings are unacceptable.

Applies to: Aircraft forms filed for multiple insurers under common ownership or management

Filer type: insurer

Conditions and exceptions: This rule is established for aircraft filings. Do not generalize it to every P&C line without the applicable line checklist.

Note: Scope narrowed to the product for which the published checklist supplies the rule.

Packaging

A form will not be approved until the rates, rules, and minimum premiums for use with it have been accepted for filing.

Applies to: Forms governed by 50 Ill. Adm. Code Part 2302

Conditions and exceptions: The regulation establishes coordination, but does not by itself say the items must share one SERFF tracking number.

Note: Do not normalize this as combined-required without evidence about the SERFF tracking-number workflow.
