The current Department landing page still requires the Delaware Personal & Commercial Filing State Specifics form. It asks about coverage restrictions broadenings premium effects affected classes and 60 months of rate history and requires a company-officer certification.

Exemption

The listed forms are outside §2712's general form filing requirement. The commissioner may also exempt a document or form type by order when filing/review is impracticable or unnecessary for public protection.

Form

Method

Delaware classifies forms as file-and-use with authority to disapprove. The form must be filed at least 30 days before delivery; it becomes effective after 30 days if not disapproved or earlier if affirmatively acknowledged. The commissioner may extend review by up to 30 days.

Note: The Department asks filers electing to deem a filing to contact rate@delaware.gov.

Rate · Rule

Method

Ordinary P&C rate and rating-rule filings are prior approval and must be submitted at least 60 days before the proposed effective date. They are deemed compliant after 60 days unless the commissioner disapproves or gives notice within 45 days that additional review up to 90 days is needed.

Rate

Method

A specific specially rated inland-marine rate and a special surety or guaranty bond rate required by law or public order become effective when filed and remain deemed compliant until rejected.

Packaging

Delaware's current SERFF configuration actively permits Form/Rule Form/Rate Form/Rate/Rule and Rate/Rule filings as well as separate Form Rate and Rule submissions.

Note: 1,149 Form/Rate/Rule and 1,849 Form/Rule filings were observed in the current corpus.
