Exemption

Appendix A business is exempt from the Department's normal filing-review procedure but companies must continue filing the commercial forms rates rules amendments and endorsements through SERFF using an Exempt filing type and an officer compliance certification.

Applies to: Commercial lines listed in Appendix A to Bulletin PC-63-24

Conditions and exceptions: The exemption does not cover personal lines rating organizations workers' compensation excess workers' compensation medical malpractice professional liability environmental impairment claims-made municipal business mixed exempt/nonexempt filings or other unlisted business.

Note: Commercial inland-marine rates and rules are not required by Connecticut law according to Appendix A; optional submissions may use Exempt.

Form

Method

Covered forms must be filed before issuance. Connecticut calls the regime file-and-use; after a complete filing is accepted the Department has 30 calendar days to record it effective or disapprove it subject to tolling while additional information is requested.

Applies to: Policy contract or endorsement other than fidelity surety or guaranty bonds

Conditions and exceptions: A deficient submission is not accepted for review. Product-specific statutes and the current commercial review exemption require separate rows.

Note: The 30 days is a Department review cycle rather than a general prior-approval waiting period.

Rate · Rule

Method

Commercial classifications rules rates rating plans schedules and systems are filed for the Commissioner's information on or before their effective date.

Applies to: Ordinary commercial risk other than statutory exceptions

Conditions and exceptions: Customarily nonmanual inland marine risks are excluded; workers' compensation employers' liability and specified medical professional liability follow separate rules.

Rate

Method

These rates are subject to prior approval. An increase of 7.5% or more requires a filing and insured notice at least 60 days before the proposed effective date; the commissioner must decide within 45 days after receipt subject to the hearing process.

Applies to: Physicians surgeons hospitals APRNs and physician assistants

Conditions and exceptions: The 60-day notice threshold applies to increases of at least 7.5%; prior approval applies to the covered rates generally.

Workers' compensation and employers' liability rate filings have a 30-day waiting period before effectiveness with a possible written 30-day extension and a deemer if not disapproved. The commissioner may authorize earlier effectiveness after review.

Effective July 3 2024 claims-made forms were removed from the commercial review exemption and require complete Department review.
