Method

A coverage-form filing for a Proposition 103 line is submitted under the Prior Approval Rate Application workflow. If the insurer asserts no rate impact it must submit the form or rule filing at least 90 days before the proposed effective date and may not implement it until the Department confirms there is no rate impact.

Form

Method

When a proposed form change may affect rates the insurer must submit a complete prior-approval rate application with full rate support and may not treat it as a form-only no-impact filing.

Applies to: Coverage-form change with rate impact

Conditions and exceptions: The insurer must identify the rate impact; forms restricting deleting or excluding coverage require consideration of an offset or credit.

Note: The statutory rate deemers in §1861.05(c) govern the complete rate application. They should not be presented as a universal form-only clock.

Method

A covered rate change requires prior approval. Section 1861.05 contains a 60-day post-public-notice provision and a separate 180-day receipt-based deemer subject to hearing and extraordinary-circumstance rules.

Method

Workers-compensation policy forms and endorsements are submitted through the licensed rating organization rather than directly by an insurer. Standard forms may be used after written WCIRB notice that they are ready for use; nonstandard forms require filing through WCIRB and Commissioner approval before use.
