Exemption

Qualifying commercial P&C in a competitive market is exempt from rate filing and review; nonmanual individual-risk and referral-to-company rates have a separate exemption with documentation retention.

Applies to: Commercial risks other than workers compensation employers liability and professional liability

Conditions and exceptions: Workers compensation employers liability professional liability and noncompetitive-market business are excluded; the commissioner may change market treatment by order.

Form

Method

Every filing must be made at least 30 days before the proposed effective date. It deems approved after 30 days unless affirmatively approved or disapproved; the Department may extend review by another 30 days with timely notice.

Applies to: General P&C policy forms governed by Ark. Code §23-79-109 and 23 CAR §200-106

Conditions and exceptions: Surety bonds and unique forms for a particular subject are outside §200-106; other statutory exemptions may apply.

A competitive-market filing is due 20 days before the effective date and becomes effective after the waiting period or sooner if approved.

Applies to: Personal and other nonexempt risks subject to §23-67-211

Conditions and exceptions: Commercial risks may fall within the broader competitive-market exemption in §23-67-206; an insurer under closer supervision uses 60 days.

Arkansas's operative rule says rate and form filings must be made separately. A 2025 objection expressly required rates/rules to be removed from a Form/Rate/Rule filing and submitted separately.
