Form

Method

The filer generally may elect prior approval and must identify that method. A prior-approval filing is made at least 30 days before the effective date and deems approved after 30 days unless disapproved; the director may extend the period once by up to 30 days.

Applies to: General form filing within AS 21.42.120 and not an enumerated exception

Conditions and exceptions: Title workers' compensation exempt-commercial and order- or regulation-specific filings follow separate rules.

Form

Method

The filer generally may elect file-and-use. The filing has a fixed 30-day waiting period and may be extended once for 30 additional days by the filer or Division. Unresolved filings are disapproved or withdrawn rather than held indefinitely.

Applies to: General form filing within AS 21.42.120 and not an enumerated exception

Conditions and exceptions: Only one extension in total is allowed for this method. The effective date is no earlier than the day after the waiting period unless earlier authorization is granted.

Method

An eligible cumulative rate-level increase or decrease of no more than 10 percent during the statutory 12-month measurement period may take effect on the date specified in the filing but not before the Division receives it.

Applies to: Eligible rate change within statutory flex bands

Conditions and exceptions: Workers compensation medical malpractice assigned-risk rating organizations and specified impaired or supervised insurers are excluded; aggregate change is measured as prescribed by § 21.39.210.
