Rate

Method

A commercial rate filing seeking an overall increase of 10% or more is prior approval. Current DOI guidance also treats a proposal that combines with an earlier increase to exceed 10% in less than 12 months as ineligible for file-and-use.

Applies to: An overall commercial rate increase of 10% or more or cumulative increases exceeding 10% in less than 12 months

Conditions and exceptions: Regulation 123 expressly states the 10% test for rate filings; the DOI page explains the less-than-12-month cumulative scenario.

Note: Collected because the exception can change the method for a filing package. Do not automatically apply the rate exception to a separately submitted form filing.

The Department asks filers to submit rate and rule filings separately from form filings to expedite review. Current SERFF records expose Form Rate Rule and Rate/Rule types but no combined form-rate-rule type.
